DISTANCE SALES AGREEMENT

1. PARTIES

This agreement has been prepared for the purpose of regulating the procedures and principles regarding distance sales transactions between BenBuldum.com, which provides listing services (hereinafter referred to as the “Platform”), and the Customer who purchases services through the Platform.

BenBuldum.com provides only listing sales, subscription packages, commitment-based and non-commitment memberships, and listing promotion (visibility enhancement) services.

2. DEFINITIONS

Platform: The BenBuldum.com website and mobile applications.
BenBuldum: The legal entity providing listing and visibility services on the Platform.
Customer: The natural or legal person who purchases services via BenBuldum.
Listing Sale: A paid service granting the right to publish a listing.
Subscription Package: Service packages that increase the number of listings or offer additional features.
Boost (Visibility Enhancement): An additional service that increases the visibility of a listing.
Commitment-Based Service: Services provided with a commitment for a specific period.
Non-Commitment Service: Services provided without any time limitation.

3. SUBJECT AND SCOPE OF THE AGREEMENT

This Agreement regulates the rights and obligations of the parties regarding paid listing, subscription packages, and listing promotion services provided by BenBuldum.

BenBuldum is solely responsible for listing publication and visibility enhancement services. The accuracy and legal compliance of listing content are entirely the responsibility of the Customer.

4. OBLIGATIONS OF BENBULDUM

BenBuldum provides listing publication and visibility enhancement services to customers.
The scope and content of the service shall comply with the features specified at the time of purchase.
It is obliged to provide support in case of technical issues that may occur in the services.
In the event of early termination of commitment-based services, the discount amount corresponding to the used period shall be charged.
Upon expiration of the service period in commitment-based packages, no refund shall be made for the remaining period.

5. OBLIGATIONS OF THE CUSTOMER

The Customer is obliged to provide accurate and complete information while using listing services.
The Customer is responsible for misleading or incomplete information contained in listings.
In commitment-based service purchases, the Customer agrees to pay a withdrawal fee equal to the discount amount in case of early termination.
Listing promotion and visibility enhancement services cannot be cancelled or refunded.

6. PAYMENT AND REFUND TERMS

Payments are securely processed through the Platform’s virtual POS infrastructure.
Card information is not stored; payment security is entirely the responsibility of the virtual POS provider.
Refunds are processed in accordance with the procedures determined by the payment service provider. BenBuldum cannot intervene in the payment process.
Commitment-based service cancellation: The discount amount corresponding to the number of months used is deducted; if any remaining balance exists, it shall be refunded.
Non-commitment service cancellation: No refund shall be made for unused periods of the cancelled term.

7. DISPUTES AND COMPETENT COURT

In the event of disputes arising between the parties, an amicable settlement shall be sought first.
If no settlement is reached, Istanbul Courts and Enforcement Offices shall have jurisdiction.

8. LEGAL BASIS AND PROVISIONS

This Agreement has been prepared in accordance with the Consumer Protection Law No. 6502 and the relevant legislation.
It shall enter into force on the date it is approved electronically by the parties.

9. PAYMENT INTEGRATION

BenBuldum uses a payment intermediary for payment transactions.
Members agree to comply with the security rules determined by the payment intermediary during payment.
Card information is not stored directly; the terms of the payment intermediary apply, and all responsibility regarding card security belongs to the payment intermediary company. With respect to payment transactions, the user’s direct counterpart is the virtual POS provider.

10. ENTRY INTO FORCE

This Agreement shall enter into force at the moment it is approved electronically by the Customer and shall remain valid throughout the service period.
By accepting this Agreement, the Customer undertakes to benefit from the service in accordance with the provisions of the Agreement.
